Welcome to Storypie. The following Terms of Use and End-User License Agreement ("EULA" or "Terms") regulate your access to and use of the Storypie app ("Licensed Application" or "App"), our website mystorypie.com ("Website"), and any related services (collectively, our "Services") provided by Storypie LLC. By using our App or Website, you signify your agreement to these Terms. If you disagree with these Terms, kindly refrain from using our App and Website.
Please read these Terms carefully before you accept. We draw your attention to:

Accounts must be created by an adult who is at least 18 years old, such as a parent, guardian, or educator. Children under 13 may use the Services only through an account created and supervised by a parent, guardian, or educator. Users aged 13 to 17 need the permission of a parent or guardian. School accounts are governed by the school's agreement with Storypie and our Privacy Policy's section on student data.
Certain features of our App require you to create an account. During account creation, you agree to:
If you have not used your Account for an extended period of time (12 months or more of inactivity), we may close and permanently delete your Account. You acknowledge and agree that this means you will lose any Content you generated. We will notify you via the email address you provided when creating your Account prior to deleting your Account.
Our Services integrate various artificial intelligence technologies to generate content including text, images, and other media. These AI services are provided by established third-party providers under their respective terms and licenses.
You acknowledge and understand that AI-generated content:
By using our Services, you agree to comply with all applicable third-party terms and licenses, our acceptable use policies, platform-specific terms (Apple App Store or Google Play Store), wireless data service agreements, and all applicable laws and regulations. You must not violate any third-party agreements when using our Licensed Application.
Upon your adherence to these Terms, we provide you a limited, non-exclusive, non-transferable, non-sublicensable license to download, install, and utilize our App for personal or educational use as described in these Terms. For Apple App Store users, this license is specifically limited to Apple-branded products you own or control, subject to Apple's Usage Rules. The same applies to the access and use of our Website.
The following actions are not permitted:
Our Services, including the Licensed Application, Website, and all Content generated, are provided to you for your personal, non-commercial use, or for the educational use described below. This is a fundamental condition of the license granted to you in these Terms.
Educational use is permitted. Teachers, schools, school districts, libraries, childcare centers, tutoring providers, homeschool families, co-ops, and other educational organizations, whether nonprofit or for-profit, may use the Services and Content for instruction, including creating, printing, and sharing materials with their own students and learners, under an educator or school account or a written agreement with Storypie. Selling or redistributing Content outside that educational setting remains prohibited.
Other than the educational use described above, you may not use the Services or any Content for any commercial purpose. Prohibited commercial uses include, but are not limited to:
Any violation of this non-commercial use restriction is a serious breach of these Terms and will result in the immediate termination of your account and license to use the Services and Content.
When you submit any material or data to the Service, it is termed as "Input". The resulting creation or product from our Services based on your Input is referred to as the "Output". Together, both Input and Output are addressed as the "Content".
Storypie LLC owns the Output generated by the Services, and grants you the license described below. You retain ownership of the Input you provide, and grant Storypie LLC a limited, non-exclusive, royalty-free license to host, store, and process it to provide, secure, and support the Services. If you choose to make a story public, you also grant Storypie LLC a non-exclusive, royalty-free license to display, feature, and share that story, including in the Storypie library and in our promotional materials, for as long as the story remains public. For accounts provided through a school, district, or other educational institution, all student data and all content created by students remain the property of and under the control of that institution, and are never made public or featured.
Storypie LLC grants you a limited, non-exclusive, non-transferable, non-sublicensable, and revocable license to use the Output you generate through our Services for personal or educational use as described in these Terms. This license is strictly contingent upon your adherence to these Terms. Apart from the educational use described in these Terms, you may not use the Output for any commercial purpose.
Storypie LLC may access Content only as needed to provide and maintain the Services, provide support you request, keep the Services secure, enforce these Terms, and display and feature stories you make public. We do not use content created by or about children, or student data, to train artificial intelligence models.

If your Premium Subscription expires and you are not on an active auto-renewing plan, your account will revert to the Basic Plan. Upon expiration, you will lose access to premium features and to stories created beyond the Basic Plan limit. Each story keeps its current public or private setting, and you can still make any of your stories private. You will only be able to access the number of stories permitted under the then-current Basic Plan limits, starting with your oldest created stories.
All payments are processed through the Apple App Store (iOS users), Google Play Store (Android users), or Stripe. You must comply with the respective platform's payment terms and conditions.
Our Services are designed for a mixed-audience, and we are committed to providing a safe experience. In compliance with App Store and Google Play guidelines, our App includes a neutral, age-appropriate parental gate before a child can link out of the app or engage in any commerce opportunities. This ensures that any such actions are performed with parental consent.
You and Storypie LLC acknowledge that this EULA is concluded between you and Storypie LLC only, and not with Apple Inc. ("Apple"), and that Storypie LLC, not Apple, is solely responsible for the Licensed Application and the content thereof. This EULA does not provide for usage rules for the Licensed Application that are in conflict with the Apple Media Services Terms and Conditions.
The license granted to you for the Licensed Application is limited to a non-transferable license to use the Licensed Application on any Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions, except that such Licensed Application may be accessed and used by other accounts associated with the purchaser via Family Sharing or volume purchasing.
Storypie LLC is solely responsible for providing any maintenance and support services with respect to the Licensed Application, as specified in this EULA, or as required under applicable law. You and Storypie LLC acknowledge that Apple has no obligation whatsoever to furnish any maintenance and support services with respect to the Licensed Application.
Storypie LLC is solely responsible for any product warranties, whether express or implied by law, to the extent not effectively disclaimed. In the event of any failure of the Licensed Application to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Licensed Application to you; and that, to the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to the Licensed Application, and any other claims, losses, liabilities, damages, costs or expenses attributable to any failure to conform to any warranty will be Storypie LLC's sole responsibility.
You and Storypie LLC acknowledge that Storypie LLC, not Apple, is responsible for addressing any claims of yours or any third party relating to the Licensed Application or your possession and/or use of that Licensed Application, including, but not limited to: (i) product liability claims; (ii) any claim that the Licensed Application fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation. This EULA does not limit Storypie LLC's liability to you beyond what is permitted by applicable law.
You and Storypie LLC acknowledge that, in the event of any third party claim that the Licensed Application or your possession and use of that Licensed Application infringes that third party's intellectual property rights, Storypie LLC, not Apple, will be solely responsible for the investigation, defense, settlement and discharge of any such intellectual property infringement claim.
You represent and warrant that (i) you are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country; and (ii) you are not listed on any U.S. Government list of prohibited or restricted parties.

Any end-user questions, complaints or claims with respect to the Licensed Application should be directed to the contact information above.
You must comply with applicable third party terms of agreement when using the Licensed Application. If you have a data service agreement with a wireless carrier, you must not be in violation of such agreement when using the Licensed Application. You are responsible for any data charges incurred while using the Licensed Application.
You and Storypie LLC acknowledge and agree that Apple, and Apple's subsidiaries, are third party beneficiaries of this EULA, and that, upon your acceptance of the terms and conditions of this EULA, Apple will have the right (and will be deemed to have accepted the right) to enforce this EULA against you as a third party beneficiary thereof.
Refund requests for purchases made through the Apple App Store or Google Play must be submitted through the respective platform, and are subject to their refund policies. For purchases made via Stripe, please contact our support team at support@mystorypie.com. To validate refund eligibility and prevent fraud, we may share transaction data, usage information, and account details with the relevant payment processor.
For subscriptions purchased through an ESA marketplace — including ClassWallet, Odyssey, MyScholarShop / Step Up For Students, and any state-administered ESA program — Storypie offers a 30-day refund period from the date of purchase. After 30 days, ESA-funded subscriptions are non-refundable and we do not prorate fees for partial billing periods or unused features (including monthly AI generation quotas, which reset each billing cycle and do not carry value once the period begins). Any approved refund within the 30-day window is issued back to the originating ESA marketplace or scholarship funding account, never to the family directly, in compliance with program rules. Where a funding agency conducts an audit clawback, a family disenrolls from an ESA program mid-term, or a marketplace requires a refund outside the 30-day window for program-administration reasons, Storypie will work with the marketplace on a case-by-case basis. Storypie reserves the right to deny refund requests where the account shows evidence of unusually high consumption of metered AI features (curriculum, lesson plans, worksheets, Create-mode generations) prior to cancellation.
You agree not to misuse our Services or AI Models. Prohibited actions include creating content that is hostile, offensive, discriminatory, sexually explicit, misleading, or violent, or that infringes on any third-party rights. Violations may result in immediate account termination, content removal, and potential legal action.
We employ filters for age-appropriate content but cannot guarantee universal content standards. Adults must review content before sharing with children.
Adults are responsible for reviewing all generated content, ensuring age-appropriate usage, and monitoring children's access.
Your use of the App and Website is subject to our Privacy Policy, available here. By using our Services, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.
We reserve the right to suspend or terminate your account and access to the Services immediately, without prior notice or liability, for any reason whatsoever, including, without limitation, if you breach these Terms.
Any use of our Services that we, in our sole discretion, deem to be an abuse of the Services constitutes a serious violation of these Terms. "Abuse" will be determined by us in our sole discretion and includes, but is not limited to, actions such as attempting to bypass content filters, generating prohibited content, excessive use of resources, or any activity that disrupts or harms our Services, infrastructure, or community. Upon termination for abuse, your right to use the Services will immediately cease.
You may terminate your account at any time by discontinuing use of the Services. All provisions of these Terms which by their nature should survive termination shall survive, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability. All fees paid are non-refundable, except for subscriptions purchased through an Education Savings Account marketplace, which may be refunded within 30 days of purchase as described in the Education Savings Account (ESA) Marketplace Refunds section. Purchases made through the Apple App Store or Google Play are also subject to those platforms' own refund policies.
In no event shall Storypie LLC be liable for any indirect, incidental, special, or consequential damages. Our total liability is limited to the fees you paid to us in the 12 months prior to the claim. This limitation does not apply to the extent prohibited by applicable law.
The Services are provided "as is" and "as available" without warranties of any kind, except as expressly set forth in these Terms or required by applicable law. We do not warrant that the Services will be error-free, uninterrupted, or that AI-generated content will be unique or meet your requirements. To the extent not effectively disclaimed, Storypie LLC is solely responsible for any product warranties.
You agree to defend and indemnify Storypie LLC from any claims arising from your violation of these Terms or misuse of the Services.
We may revise these Terms periodically. For significant changes, we will provide notice. Continued use indicates acceptance.
These Terms are governed by the laws of the State of Ohio, without regard to its conflict of law provisions. Any dispute arising from these Terms or your use of the Services shall be resolved exclusively in the state or federal courts located in Cuyahoga County, Ohio.
These Terms, including our Privacy Policy, constitute the entire agreement between you and Storypie LLC.
If any provision is deemed invalid, other provisions remain in effect.
You cannot assign these Terms without our consent. We may assign these Terms freely.
Provisions that by their nature should survive termination shall survive, including ownership, payment obligations, liability limitations, and indemnification.
